Minutes of the meeting of the Comox Valley Regional District Board of Variance held on Wednesday, April 24, 2019 in the boardroom of the Comox Valley Regional District offices located at 550B Comox Road, Courtenay, BC commencing at 1:00 pm.

APPOINTMENT OF CHAIR:
Ton Trieu, Manager of Planning Services, called the meeting to order and opened the floor to nominations for the position of chair. At the close of nominations, Joe Schommer was the only nomination and as such, was declared chair by acclamation.
 
 
RECOGNITION OF TRADITIONAL TERRITORIES
The chair acknowledged that the meeting was being held on the unceded traditional territory of the K’ómoks First Nation.
 
 
REPORTS:
BOARD OF VARIANCE BACKGROUNDER
 
 
Chair Schommer reviewed the background information regarding the Board of Variance role and process. [Item
 
 
ELECTORAL AREA A - BOARD OF VARIANCE APPLICATION - 8288 ISLAND HIGHWAY SOUTH (1075371 BC LTD.)
 
 
The board reviewed the following material:

- Report dated April 2, 2019 regarding Board of Variance application BV1A 19 to decrease the minimum required setback from a side property line that abuts a highway; [Item
 
 
- Site plan outlining the setbacks and location of the proposed dwelling. [Item
 
 
J. MacLean, Rural Planner, provided an overview of the application BV 1A 19 for 8288 Island Highway South (1075371 BC Ltd.).
 
 
Robert Boykiw, applicant, and Brian Mitchell, Mitchell Design, were in attendance and the applicant provided information regarding the application.

The Chair called for any members of the public that may wish to speak regarding BV 1A 19 - 8288 Island Highway South (1075371 BC Ltd.). Joyce Gray, adjacent neighbour, spoke and was not opposed to the application.
 
 
After deliberation, the Board of Variance rendered the following decision:
 
 
C. Halstead/A. Thomas: THAT the Comox Valley Zoning Bylaw, 2005, section 402 (2) (ii) be varied by reducing the side yard setback adjacent to the highway from 7.5 metres to 1.5 metres.
 Carried
